Actually it really comes down to UPS making a decision to have their next day delivery operations being governed under a different law than FedEx when they entered the next day business, and now asking Congress to change FedEx Express' status under the law to correct UPS' initial strategic mistake.
If UPS wants to change their business model to have their air delivery drivers fall under the RLA, I don't think Fed Ex would object.
